The firm represents its clients in all types of disputes before the courts and in arbitration proceedings. We represent our clients before the common courts, The Supreme Court of the Republic of Poland, The Court for Protection of Competition and the Consumers (see Competition) and administrative courts (see. Administrative Matters) Among court matters recently handled, we can point to disputes between companies including matters of unfair competition, corporate matters (in particular claims against resolutions taken by Shareholders Meetings, responsibilities of members of corporate bodies etc.), disputes relating to commercial transactions (the delivery of goods), construction contracts, as well as other types of disputes. Our counsels also have experience in disputes involving foreign elements where problems with jurisdiction, seizure and a conflict of laws occur.
The firm has extensive experience in domestic and international arbitration, as a result of handling arbitration proceedings on behalf of clients, and also from Prof. Wierzbowski's own experience as an arbitrator. For several years he was deputy chairman of the Court of Arbitration at the Polish Chamber of Commerce in Warsaw. Prof. Wierzbowski has also been President of the Arbitration Court of the Chamber of Brokerage Houses since its establishment. This Court deals with disputes between clients and securities brokerage houses and between brokerage houses.
The firm is experienced in handling cases before the permanent courts of arbitration as well as before ad hoc tribunals established in order to decide particular disputes, which operate according to different regulations (e.g. ICC, UNCITRAL, and PCIA). We also have experience in court and other proceedings concerning the challenging of the arbitrator and the setting aside of an arbitration award.
The highest profile arbitration case handled by the firm was that of Eureko B.V. versus the Republic of Poland, concerning the privatization of PZU. Prof. Wierzbowski was acting on behalf of the Polish Minister of the Treasury.
