The Firm has expertise in all matters related to energy and telecommunications law. In the area of energy law we handle matters concerning electricity, gas, other fuels, and the heating industry. Our Firm has been involved in obtaining necessary permits and concessions, advised on tariffs, drafting and entering agreements on the sale of energy and has advised on accessing grids including connections of wind farms. The Firm has drafted contracts for the delivery of energy and so called "complex contracts" concerning the sale and distribution of gas and energy. Last but not least, it handles disputes, including those brought before the President of the Energy Regulatory Authority and the Court deciding on appeals relating to the decisions of the President of Energy Regulatory Authority. We have handled matters of penalties levied by president of Energy Regulatory Authority, matters of so-called “green certificates” and many others concerning interactions of the energy companies and the Regulator.
We have represented energy companies in a number of court and arbitration disputes including a dispute between PGNiG and OGP Gaz-System. PGE, PGNiG, PSE, RWE Stoen, PKN Orlen, Polenergia, PERN Przyjaźń and SGT EuRoPol GAZ. The Energy Exchange as well as the Energy Regulatory Authority and the Ministry of the Economy are among our clients whom we have advised and represented in disputes with other companies or authorities.
We should also point out that the Firm has extensive experience in work connected with the potential sale of Polish natural gas and other aspects of natural gas exploitation, which are issues that fall under mining law.
The Firm's lawyers have provided services concerning the privatization of energy companies. We were counsel to the Ministry of the State Treasury in the IPO privatization of TAURON, the second largest energy company in Poland.
The Firm has also advised on a number of telecommunications matters related to agreements between operators (including MVNO), tender proceedings arranged by the President of UKE (the Telecommunications Authority), agreements for telecommunications services, measures taken by the President of UKE and disputes between operators to be decided by the Telecommunications Authority. We have also successfully represented telecommunications companies in disputes with the Telecommunications Authority (UKE) and other authorities. We have also advised private postal operators in obtaining permissions for practices necessary to begin competing with Polish Post - the Government owned postal operator.
We have considerable experience in grid (both electricity and telecommunication) matters, including ownership problems and the construction of grids and poles, including preparatory works concerning the introduction of so - called “smart grids” to Poland.
Dr Stankiewicz, Prof. Wierzbowski and Mr. Rypina are the Firm’s experts in energy and telecommunication law. Mr. Jakszuk and Mr. Radowicki are handling postal operator’s matters. Prof. Wierzbowski was an advisor to the president of Energy Regulatory Authority.
